PRIVACY POLICY

Please read the following Privacy Policy (“PP,” “Policy” or “Agreement”) carefully before viewing or using any services, features, content or applications offered by Tribe PM, Inc., a Delaware Corporation, (“Tribe,” “we,” “us” or “our”) via tribe.do (as “Site,” “Software” or collectively as “Service(s)”). This Policy applies to both those who access the Site but do not have accounts (“Visitors”) as well as those who register to gain access to the Software (“Members”) collectively (“User(s),” “You,” or “Your(s)”).

I. Preamble and General Principles

    A. Tribe PM, Inc. (“Tribe”) has created this privacy statement in order to demonstrate our respect for Yours and our firm commitment to, privacy. This policy describes our practices on tribe.do (the “Site,” “Software” or “Service(s)”) where it is posted. It also applies to SMS messages, cloud storage, and emails.
    The following information is designed to help You understand how we collect, use, disseminate and safeguard the information You provide to us while accessing and using our Software. You agree to the terms in this policy when You use this Software . If You do not agree with our information practices, please do not access or use our Software.
    B. This Policy does not apply to our use of employee information. It also does not apply to information we collect from You offline.
    C. The primary and intended purpose of the Software is to help the world work smarter and faster by building team collaboration tools that are a direct extension of your mind. Tribe removes the friction of managing, tracking, and assigning work between team members and is the fastest, most transparent team collaboration platform to date.
    Tribe helps your people get the credit for the work they do, it prevents important tasks from slipping through the cracks, and it provides executives insight and visibility into what’s really happening on the ground. For purposes of the Site, “Visitor(s)” are those who traffic the Site but do not register for an account, “Member(s)” will be those who have registered for an account, collectively “User(s).”

II. Revisions to this Policy
This Policy may change from time to time, without notice other than appearing on a Tribe Site. Tribe reserves the right to revise, amend, or modify this Policy and our other policies and agreements at any time and in any manner. Your continued use of the Software constitutes your agreement to all revisions of the Policy. Users should note the date of last revision to this Policy, which appears at the top of this Policy. This Policy was last revised on October 30, 2015.
If the “last modified” date remains unchanged after a User has clicked the “refresh” button on his/her browser, the User may presume that no changes have been made since the last reading of the Policy. A changed “last modified” date indicates that this Policy has been updated or edited, and the updated or edited version supersedes any prior versions immediately upon posting.

III. Types of Data.
“Personal Data” means data that allows someone to identify or contact You, including, for example, your name, address, telephone number, e-mail address, as well as any other non-public information about You that is associated with or linked to any of the foregoing data. It does not include personal information that is encoded or Anonymous Data.
“Sensitive Data” is additional data that would be included would include data revealing race, ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, or information on criminal or administrative proceedings other than in the context of pending legal proceedings.
“Anonymous Data” means data that is not associated with or linked to your Personal Data; Anonymous Data does not, by itself, permit the identification of individual persons. We collect Personal Data and Anonymous Data.
A. General Site Purpose, Data/Information Collection and Disclosure.
While the Site is designed so that Users may generally browse it without providing any Personal Data, certain areas of the Software will require at a minimum, your email address. Tribe uses your Personal Data for the purposes it was submitted by You to Tribe and for Tribe to send You news, publications and invitations that may be of interest to You as well as for the functionality and general usage of the Services given the essential need to use and send tasks through electronic mail.

Other general uses of the Personal Data You submit to us is used to respond to requests that You make.

We may use or disclose your Personal Data, including but limited to, the ways and for any reason if, in our sole discretion, we believe that it is reasonable to do so, including the following:

    •Registration: allow You to register for our Services and to administer and the registration;
    •Improve Customer Service: Information Users provide helps us respond to customer service requests and support needs more efficiently;
    •Communication: to communicate with You about our Services and related issues;
    •Improve Our Services: We may use feedback You provide to improve our content, products, services, etc.;
    •Administrative: to maintain and administer our Services and comply with our legal or internal obligations and policies of which may include disclosure to employees, consultants, affiliates or other businesses or persons for the purpose of processing such information on Our behalf. In such circumstances, we require that these parties agree to protect the confidentiality of such information and to comply in all respects with this Policy.
    •Legal requirements: to transfer information to others as described in this policy or to satisfy our legal, regulatory, compliance, or auditing requirements;
    •Periodic electronic mail: We may use the email address Users provide to send the User information and updates, Services, and/or other requests. If Users should opt-out of our mailing list if they would not like to receive emails that may include our news, updates, related Services information, etc. If at any time the User would like to unsubscribe from receiving future emails, they may do so through the links within the email of by contacting us via the Site and allowing us a reasonable amount of time, according to the laws where the User is located, to comply with the unsubscribe and to scrub the User from our mailing list.

We may also share non Personal (such as anonymous User usage data, referring/exit pages and URLs, platform types, number of clicks, etc.) with interested third parties to assist them in understanding the usage patterns for certain content, services, advertisements, promotions, and/or functionality of the Services. Similarly, we may share Sensitive Data so long as it is not aggregated with Personal data and therefore cannot be connected to any person.

IV. Commitment to Children’s Protection
While our Site is not targeted or intended for children under the age 13, we will not restrict a youngsters’ use of our Software. Importantly, any and all Personal Data collected or input by a child under the age of 13 will be private and should any be made public and it is brought to Our attention it will be deleted according to any applicable laws such as the Child Online Privacy Protection Act (COPPA).

V. Your Choices.
You can opt out of marketing emails or text messages by following the instructions in any marketing emails or text messages You receive. You can also opt-out by sending us an email. To request changes to or to review your information, please send us an email. You may also email us to have your personal information deleted.

    a. You can choose not to provide personal information. However if You don’t provide us with information some Software features may not work. You can also choose to configure your browser not to accept cookies. If You do so, however, some parts of our Software may not work, for example the ability to remain logged in.
    b. You can control cookies and tracking tools. Your browser may give You the ability to control cookies or other tracking tools. How You do so depends on the type of tool. Certain browsers can be set to reject browser cookies. To control flash cookies, which we may use on certain websites from time to time, You can go here. Why? Because flash cookies cannot be controlled through your browser settings. If You block cookies on your browser, certain features on our Site may not work. If You block or delete cookies, not all of the tracking activities we have described here will stop. Choices You make are both browser and device-specific.     c. Our Do Not Track Policy. Some web browsers have a “Do Not Track” feature. This feature lets You tell websites You visit that You do not want to have your online activity tracked. These features are not yet uniform across browsers. Our Services are not currently set up to respond to those signals.

VI. Users Outside the United States.
If You are a User of the Services who resides in a country other than the United States, your accessing or using the Services in any way constitutes your agreement that (a) We may process your Personal Data for the purposes identified in the Policy, and (b) your Personal Data may be transferred to and processed in the country in which it was collected and in other countries, including the United States, where laws regarding processing of Personal Data may be less stringent than the laws in your country. By providing your Personal Data, You consent to such transfer.

VII. California Residents
Residents of the State of California have the right to request a list of all third parties to which Tribe has disclosed certain information during the preceding year for the third parties’ direct marketing purposes as stated in California Civil Code Section 1798.83.

However, it is our policy to not disclose personal information in any way other than for the purposes included in this Policy. In the future if the Policy changes in this respect, You have given us your email address to contact You with any material changes, and You are a California resident and want such a list, please contact us at Privacy@Tribe.do with subject “California Privacy Rights” or:

VIII. Cookies Policy.
A “cookie” is a small data file that can be placed on your hard drive when You visit certain websites. A “web beacon” is a small, transparent graphic image placed on a website, which allows the site to record the actions of a visitor opening the page that contains the beacon. Tribe uses cookies and may use web beacons to collect, store, and sometimes track information for statistical purposes to improve Services performance and delivery.
We use cookies to save your login credentials. These cookies do not enable third parties to access any of your customer information. Advertisers and partners may also use their own cookies. We do not control use of these cookies and expressly disclaim responsibility for information collected through them.
Your browser may give You the ability to control cookies or other tracking tools. How You do so depends on the type of tool. Certain browsers can be set to reject browser cookies. To control flash cookies, which we may use on certain websites from time to time, You can go here. Why? Because flash cookies cannot be controlled through your browser settings. IX. Online Advertisements.
While Tribe does not currently feature online advertisements and it does not intend to in the future, Tribe has the right to do so in the future. At such time, Tribe would not be responsible for use of information by third-party websites of which are not affiliated with Tribe.

X. Security.
Your data has been password protected, encrypted with 2048-bit SHA-2 SSL and is stored on a cloud server hosted by Azure, the most trusted Cloud platform for the Fortune 500. Tribe has also implemented and followed other appropriate technical measures to protect against the risks of unauthorized access to, erroneous disclosure of, and unlawful interception of Personal Data.
BUT, the Internet is not 100% secure. While Tribe uses commercially reasonable physical, managerial and technical safeguards to preserve the integrity and security of your data and information, we cannot promise that your use of our Services and data You provide will be completely safe for all time and under all circumstances. We encourage You to use caution on the Internet.

XI. In the Event of Merger, Sale, or Bankruptcy.
In the event that we are acquired by or merged with a third party entity, we reserve the right to transfer or assign the information we have collected from Users as part of such merger, acquisition, sale, or other chance of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally we may not be able to control how your personal information is treated, transferred, or used.

Please include your name, address and telephone number (if You prefer to receive a call back rather than email) when You contact us. This helps us handle your request quickly and correctly.
Complaints will be resolved internally in accordance with our complaints procedures. If You live in the European Union or Switzerland and efforts to resolve the matter internally are unsatisfactory, the complaint may be submitted to the American Arbitration Association, which has been selected as the independent recourse mechanism to resolve complaints and disputes relating to treatment of data originating in the European Union or Switzerland under this policy.

This Policy does not supersede the Terms of Use governing your use of the Services. Any conflict between the two shall be resolved in favor of the Terms of Use.
